These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and TypenDrop Distributions ("TypenDrop," "we," "us," or "our") governing your access to and use of the TypenDrop website, application, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We may modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Service Description

TypenDrop is an AI-powered page builder that generates Elementor-compatible page layouts based on user prompts. The Service enables you to:

• Generate page designs and content using artificial intelligence
• Export generated pages for use in WordPress with Elementor
• Connect to your WordPress website to deploy pages directly
• Customize and iterate on generated designs

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Creation

To access certain features of the Service, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized access to your account

Account Security

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscription & Payment

Pricing

Access to the Service requires a paid subscription. Current pricing and plan details are available on our website. We may change our pricing at any time, but changes will not affect your current billing period.

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Payment Processing

Payments are processed securely through our payment provider (Stripe via Autumn). By providing payment information, you authorize us to charge the applicable fees to your payment method.

Failed Payments

If a payment fails, we will attempt to process the payment again. If payment cannot be processed after multiple attempts, we may suspend or terminate your access to the Service.

Credits

The Service operates on a credit-based system. Credits are consumed when you generate pages. Unused credits do not roll over between billing periods unless otherwise specified in your plan. Credits have no cash value and are non-transferable.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on intellectual property rights of others
• Generate content that is sexually explicit or pornographic
• Generate content that promotes violence, discrimination, or hatred
• Generate content that impersonates another person or entity
• Generate content designed to deceive, defraud, or mislead
• Generate spam, phishing pages, or malicious content

Prohibited Activities

• Attempt to gain unauthorized access to the Service or related systems
• Use automated tools, bots, or scripts to access or interact with the Service in a manner that exceeds normal usage
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the Service to develop competing products or services
• Resell, sublicense, or redistribute the Service without authorization
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to circumvent usage limits, credit systems, or security measures

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending accounts, and reporting violations to law enforcement.

6. Intellectual Property Rights

Our Intellectual Property

The Service, including its original content (excluding user-generated content), features, functionality, design, code, and branding, is owned by TypenDrop Distributions and is protected by copyright, trademark, and other intellectual property laws.

"TypenDrop," our logo, and other marks are trademarks of TypenDrop Distributions. You may not use our trademarks without our prior written consent.

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

7. User Content & Generated Content

Your Content

You retain ownership of any content you provide to the Service (such as prompts, images, and settings). By providing content, you grant us a license to use it solely to provide and improve the Service.

Generated Content

Content generated by the Service ("Generated Content") based on your prompts is yours to use. You own the Generated Content and may use it for any lawful purpose, including commercial use, subject to the following:

• Generated Content may not be unique; similar prompts may produce similar results for other users
• We do not guarantee that Generated Content is free from third-party intellectual property claims
• You are responsible for reviewing Generated Content before use
• Generated Content is provided "as is" without warranties

License to Us

You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content and Generated Content for the purpose of operating, improving, and developing the Service. This includes using anonymized and aggregated data to improve our AI models.

8. Third-Party Services

The Service integrates with and relies on third-party services:

WordPress & Elementor

TypenDrop generates content compatible with WordPress and Elementor. Your use of WordPress and Elementor is subject to their respective terms and licenses. We are not affiliated with, endorsed by, or sponsored by Automattic (WordPress) or Elementor Ltd.

AI Providers

We use third-party AI models to power content generation. The output of these models may be subject to their respective terms of use and acceptable use policies.

Payment Providers

Payment processing is handled by third-party payment processors. Your use of payment services is subject to their terms and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services, and you use them at your own risk.

9. Disclaimers

Without limiting the foregoing, we specifically disclaim:

• No guarantee of AI output quality: We do not guarantee that Generated Content will meet your expectations, be error-free, or be suitable for any particular purpose
• No guarantee of availability: We do not guarantee uninterrupted, secure, or error-free operation of the Service
• No professional advice: Generated Content is not a substitute for professional design, legal, or business advice
• Third-party dependencies: We are not responsible for issues arising from WordPress, Elementor, or other third-party services
• Your website: We are not responsible for issues that occur on your WordPress website after deploying Generated Content

10. Limitation of Liability

Our total liability to you for all claims arising from the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless TypenDrop Distributions and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your User Content or use of Generated Content
• Any content deployed to your WordPress website using the Service

12. Termination

Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us. Upon cancellation, you will retain access until the end of your current billing period.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activity
• Your payment method cannot be processed
• We are required to do so by law
• We discontinue the Service

Effect of Termination

Upon termination:

• Your right to access the Service will immediately cease
• You will not receive a refund for any unused portion of your subscription (except as provided in our Refund Policy)
• We may delete your account data after 30 days
• Provisions that by their nature should survive termination will survive

13. Dispute Resolution

Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at support@typendrop.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Rome, Italy. However, if you are a consumer residing in the European Union, you may also bring proceedings in your country of residence.

EU Consumer Rights

If you are a consumer in the European Union, you have the right to access the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and TypenDrop regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or failures of third-party services.
